By accessing or using Growtsy (growtsy.com), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service. Please read these Terms carefully — they include limitations on liability and other important provisions.
Growtsy is an AI-powered optimization tool for Etsy sellers. It provides listing analysis, keyword research, trend insights, product photography generation, and related features (together, "the Service"). We are not affiliated with, endorsed by, or sponsored by Etsy, Inc. All trademarks (including "Etsy") belong to their respective owners.
Growtsy is operated by an independent developer based in Istanbul, Türkiye. All payments are processed by Paddle.com (our Merchant of Record), as described in Section 4.1.
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Growtsy. By creating an account, you confirm you meet this requirement.

We may suspend or terminate accounts that violate this section without refund.
All payments for Growtsy are processed by Paddle, our Merchant of Record (Paddle.com, Inc.). Paddle handles payment processing, billing support, invoicing, and the collection and remittance of applicable taxes (including VAT and sales tax). Your transaction contract for the purchase is with Paddle; your service contract for Growtsy is with us.
Growtsy offers a free plan and paid subscription plans billed monthly or annually. Paid plans renew automatically at the end of each billing period using your stored payment method until cancelled. You will be charged the then-current price of your selected plan.
Paid plans and add-on packs include Growtsy Credits used to access features (listing analyses, Scout searches, Photo Studio generations, etc.). Credits have no monetary value outside the Service, cannot be exchanged for cash, and expire according to your plan terms. Unused plan credits do not roll over to the next billing period unless explicitly stated in your plan description.
Prices displayed on the Service are exclusive of VAT, sales tax, and other transaction taxes unless explicitly marked as "tax included" (for example, Turkish Lira prices displayed to Turkish customers include KDV). Applicable taxes are calculated and collected by Paddle at checkout based on your location and the applicable tax rules.
We may change the price of subscriptions. For active subscribers, price changes take effect at the start of the next billing period following at least 30 days' advance notice by email. If you do not accept a price change, you may cancel before it takes effect.
If a payment fails, we (via Paddle) will retry automatically. If the payment cannot be collected, your paid features may be suspended until the balance is resolved. Credits purchased but not yet applied may be withheld during this period.
The free plan provides limited access to the Service with monthly caps on analyses, searches, and image generations. Limits reset on the 1st of each calendar month (UTC). We reserve the right to modify free plan limits, features, or eligibility with 30 days' notice.
You may cancel your subscription at any time from Settings → Plan in the app, or by emailing hello@growtsy.com. Cancellation takes effect at the end of your current billing period; you retain access to paid features until that date. Refund eligibility is described in our Refund Policy, which forms part of these Terms.
For EEA, UK, and Turkish consumers, statutory cancellation and withdrawal rights under applicable consumer law remain unaffected.
You retain full ownership of the content you upload to Growtsy (including product images, text, and descriptions) and of the outputs generated from your content (optimized titles, tags, descriptions, generated images), subject to Section 8 regarding the legal nature of AI-generated material.
To operate the Service, you grant Growtsy a limited, non-exclusive, worldwide, royalty-free license to:
We do not use your content for AI model training or for any purpose other than providing the Service to you. This license ends when you delete the content or your account.
Photos containing people. If you upload a photo that contains an identifiable person's face (your own face, a model, or a customer), we may use AI-based detection to identify and crop the face area before generating new images, in order to protect privacy. Our face detection performs binary detection only (face present / face not present); it does not extract, store, or transmit facial geometry, faceprints, biometric templates, or other biometric identifiers as defined under laws such as the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14). For details on how we handle photos containing people, see Sections 6 and 11 of our Privacy Policy.
Growtsy uses artificial intelligence (Claude by Anthropic, FLUX Kontext Pro by fal.ai) to generate recommendations and visuals. AI outputs are provided as a starting point. They may contain errors, omissions, or content that does not comply with Etsy's current policies.
You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing it to Etsy or using it commercially.
We make no representations or warranties that using Growtsy will result in:
Subject to your payment of applicable fees and compliance with these Terms, you may use the outputs you generate using the Service (optimized titles, tags, descriptions, and AI-generated images) for your Etsy listings and related commercial purposes. We do not claim ownership of these outputs.

The legal status of AI-generated content is evolving. The U.S. Copyright Office's January 2025 report (Copyright and Artificial Intelligence, Part 2: Copyrightability) concluded that:
For most Photo Studio outputs, you upload your own product photograph (your own creative work) and the AI modifies the scene around your product. Your original photograph and the elements derived from it may be eligible for copyright protection under current U.S. guidance, while the purely AI-generated elements (synthetic backgrounds, lighting, composition) may not be. This area of law is unsettled and other jurisdictions may reach different conclusions. We do not provide legal advice; consult a qualified attorney if copyrightability of specific outputs matters to you.
To strengthen the protection and originality of AI-assisted content you publish, we recommend adding meaningful human modifications — your own editing, retouching, original copy, or arrangement choices — before commercial use.
AI models can, by their nature, produce outputs that resemble existing works, brand language, or designs. Growtsy does not warrant that outputs are unique, original, or non-infringing. We employ technical safeguards including pre-generation brand and character detection, plagiarism checks against competitor listings, and prompt-level constraints — but these safeguards are not foolproof and do not constitute a guarantee of clearance.
Before publishing AI-generated visuals you suspect may resemble existing designs, we recommend reverse-image search through tools like Google Images or TinEye.
You represent and warrant that:
Etsy distinguishes between two situations. Under Etsy's Creativity Standards (last updated June 2025), the policy treatment of AI depends on whether AI is used to create the product itself or only to photograph and describe a product you yourself made:
Listing-safe vs. Promo only. Within Photo Studio, Growtsy further distinguishes between visuals suitable for the Etsy listing gallery ("Listing-safe") and visuals intended for advertising, social media, or shop banners only ("Promo only" — for example, color-variation comparisons or AI-imagined packaging that does not reflect your actual SKU). You are responsible for using each output in the manner intended. Misusing a Promo only visual as a primary Etsy listing photo may violate Etsy's accurate-representation policy and is your responsibility.
Etsy may update its policies at any time. You are responsible for reviewing the Etsy Seller Handbook and Creativity Standards before publishing each listing.
In addition to the general indemnification in Section 13, you specifically agree to indemnify and hold Growtsy harmless from any claims arising out of: (a) your upload of content you did not have the right to use; (b) your publication of AI outputs that infringe third-party rights; (c) Etsy enforcement actions, including listing removals, shop suspensions, or DMCA notices, taken against your shop in connection with content you generated using the Service.
For users in the European Union, the EU Artificial Intelligence Act (Regulation 2024/1689) imposes transparency obligations on certain AI systems beginning 2 August 2026. We disclose the following so you can make informed decisions about Growtsy outputs:
These obligations apply primarily to deployers of AI systems (Article 50(4)) and to providers of generative AI (Article 50(2)). Growtsy is a deployer; our AI providers are the providers under the Act. If your use of Growtsy outputs in the EU triggers your own transparency obligations, those obligations are your responsibility.
The Growtsy brand, website, software, designs, workflows, prompt systems, and all associated intellectual property are owned by us or our licensors. Nothing in these Terms grants you any rights in our intellectual property beyond the limited right to use the Service as described here.
If you believe content on the Service infringes your intellectual property rights, email hello@growtsy.com with the subject "IP Notice" and include: identification of the work, description of the alleged infringement, your contact details, and a statement of good-faith belief.
The Service integrates with third-party providers (Paddle for payments, Anthropic and fal.ai for AI processing, Supabase for data storage, Vercel for hosting). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for outages, errors, or acts of third-party providers, though we work to maintain reliable integrations.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We disclaim all implied warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law, including statutory consumer rights in the EEA, UK, and Turkey.
To the maximum extent permitted by law, Growtsy, its founders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost sales, lost rankings, loss of data, or business interruption, arising out of or related to your use of the Service.
Our total cumulative liability arising out of or relating to the Service will not exceed the greater of: (a) the total amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) EUR 100.
This limitation does not apply to liability that cannot be limited under applicable law (for example, gross negligence, willful misconduct, or statutory consumer protection rights).
You agree to indemnify and hold harmless Growtsy from any third-party claims, losses, or expenses (including reasonable legal fees) arising from: (a) your uploaded content, (b) your use of AI-generated outputs, (c) your violation of these Terms, or (d) your violation of Etsy's policies or applicable law.
We may suspend or terminate your account if you violate these Terms, abuse the Service, or create legal or security risk. Where practicable we will notify you first. Upon termination, your access ends immediately; paid fees for the current period are non-refundable except as required by our Refund Policy or applicable law.
You may delete your account at any time from Settings → Account. Data deletion follows our Privacy Policy.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. Disputes arising under these Terms will be submitted to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices (İstanbul Mahkemeleri ve İcra Daireleri), except that consumers may also bring proceedings in the courts of their country of residence where required by applicable law.
For EEA and UK consumers: nothing in this section limits your right to rely on mandatory consumer protection provisions of the law of your country of habitual residence.
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email or in-app notification before they take effect. Continued use of the Service after changes become effective constitutes acceptance.
Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Growtsy regarding the Service.
Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
No waiver. Failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign these Terms without our consent. We may assign them to a successor in connection with a business reorganization or acquisition.
